1. Acceptance of Terms
By accessing or using the KINPASS platform (the “Service”), including our mobile application and website, you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Service.
2. Description of Service
KINPASS is a marketplace platform connecting parents (“Users”) with children's activity providers (“Partners”) in Malaysia. Users can discover, book, and pay for children's activities using a credit-based system. Partners can manage their classes, rosters, and payments through a dashboard.
3. User Accounts
You must be at least 18 years of age to create an account. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must provide accurate and complete information during registration.
4. Credits and Payments
KINPASS operates on a credit-based system. Credits can be acquired through subscription plans or one-time top-ups. All prices are displayed in Malaysian Ringgit (MYR). Credits are non-transferable and have no cash value.
5. Credit Rollover and Expiry
- Individual credit (without an active paid membership): Credit rollover is not permitted. Any unused credits will automatically expire and cannot be reinstated after thirty (30) days from the date of purchase.
- Explorer package: As long as your account is active and on a paid monthly plan, credit rollover is permitted. Any unused credits will roll over, up to the number of credits included in your next cycle's membership plan. (Example: If you're renewing on Explorer plan, up to 18 unused credits can roll over.)
- Adventurer package: As long as your account is active and on a paid monthly plan, credit rollover is permitted. Any unused credits will roll over, up to the number of credits included in your next cycle's membership plan. (Example: If you're renewing on Adventurer plan, up to 42 unused credits can roll over.)
- Champion package: As long as your account is active and on a paid monthly plan, credit rollover is permitted. Any unused credits will roll over, up to the number of credits included in your next cycle's membership plan. (Example: If you're renewing on Champion plan, up to 96 unused credits can roll over.)
- Free credits and additional top-up credits: Free credits and any additionally purchased credits are eligible for rollover — up to the limit of your upcoming membership plan, if you continue with a paid membership.
- Membership cancellation: If you cancel your membership, all remaining credits — including any rolled over or purchased ones — will be forfeited on the last day of your billing cycle.
6. Booking and Cancellation Policy
When you book an activity, credits are deducted from your account immediately. Our cancellation policy is as follows:
- Standard Cancellation: Bookings can generally be cancelled up to 12 hours prior to start time with no charge, and the credits used for the bookings will be automatically returned to your account.
- Late Cancellation: If a cancellation takes place within 12 hours of start time, the credits used for the bookings will be automatically returned to your account after a late cancellation fee of RM3 per returned credit has been charged.
- Missed Booking: Bookings can no longer be cancelled at start time and the credits used for the bookings will be forfeited.
- Partner Cancellation: KINPASS partners reserve the right to cancel sessions due to business disruptions or insufficient participation. Users will be notified at least 3 hours before the session, and all credits will be reimbursed in full.
A saved payment method is required before you can make a booking. If a late cancellation fee cannot be charged at the time of cancellation, your account will be temporarily restricted until the outstanding amount is settled. Appeals (e.g. medical emergencies) are reviewed by our operations team upon request and require supporting evidence.
7. Partner Obligations
Partners are responsible for the accuracy of all information in their activity listings, including descriptions, photos, age ranges, skill levels, venue details, and social medias. Partners are also responsible for delivering the activities as described, maintaining appropriate certifications and insurance, ensuring the safety of all participants, and complying with all applicable Malaysian laws and regulations.
8. Privacy and Data Protection
Your use of the Service is also governed by our Privacy Policy. We comply with the Personal Data Protection Act 2010 (PDPA) of Malaysia. Special protections apply to children's data, including parental consent requirements for processing data of minors under 18.
9. Intellectual Property
The KINPASS name, logo, platform, and all associated content are the intellectual property of KINPASS Technology Sdn. Bhd. You may not reproduce, distribute, or create derivative works without our written consent.
10. Limitation of Liability
KINPASS acts as a marketplace connecting Users and Partners. We do not directly provide activity services. While we facilitate bookings and payments, we are not a party to the contract between Users and Partners for activity services. Partners are solely responsible for the quality, safety, and delivery of their activities. KINPASS is not liable for injuries, damages, or losses arising from activities booked through the platform and delivered by Partners.
11. Changes to Terms
We may modify these Terms at any time. We will notify you of material changes via email or in-app notification. Continued use of the Service after changes constitutes acceptance of the updated Terms.
12. Governing Law
These Terms are governed by the laws of Malaysia. Any disputes shall be resolved in the courts of Malaysia.
