1. Acceptance of Terms
By accessing or using the KINPASS platform (the “Service”), including our mobile application, website, and partner dashboard, you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Service.
2. Description of Service
KINPASS is a marketplace platform connecting parents (“Users”) with children's activity providers (“Partners”) in Malaysia. Users can discover, book, and pay for children's activities using a credit-based system. Partners can manage their classes, rosters, and payments through a dashboard.
3. User Accounts
You must be at least 18 years of age to create an account. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must provide accurate and complete information during registration.
4. Credits and Payments
KINPASS operates on a credit-based system. Credits can be acquired through subscription plans or one-time top-ups. All prices are displayed in Malaysian Ringgit (MYR). Credits are non-transferable and have no cash value. Unused credits may or may not roll over depending on your subscription tier.
5. Booking and Cancellation Policy
When you book an activity, credits are deducted from your account immediately. Our cancellation policy is as follows:
- Standard Cancellation: Cancellations must be requested at least 12 hours prior to the scheduled session. Credits used for these bookings will be reimbursed in full.
- Late Cancellation: Cancellations made less than 12 hours of the scheduled session are subject to a penalty fee of RM 2 per credit used. Credits will be reimbursed to your account only after the penalty fee has been successfully processed via credit card.
- No-Show Policy: A penalty fee of RM 2 per credit used applies to all “No-Shows” after confirmed bookings. Upon successful payment of the fee, 50% of the credits used for the booking will be reimbursed to your account.
- Partner Cancellation: KINPASS partners reserve the right to cancel sessions due to business disruptions or insufficient participation. Users will be notified at least 3 hours before the session, and all credits will be reimbursed in full.
A saved payment method is required before you can make a booking. If a penalty fee cannot be charged at the time of cancellation, your account will be temporarily restricted until the outstanding amount is settled. Appeals (e.g. medical emergencies) are reviewed by our operations team upon request and require supporting evidence.
6. Partner Obligations
Partners are responsible for delivering the activities as described, maintaining appropriate certifications and insurance, ensuring the safety of all participants, and complying with all applicable Malaysian laws and regulations.
7. Privacy and Data Protection
Your use of the Service is also governed by our Privacy Policy. We comply with the Personal Data Protection Act 2010 (PDPA) of Malaysia. Special protections apply to children's data, including parental consent requirements for processing data of minors under 18.
8. Intellectual Property
The KINPASS name, logo, app, website, and all associated content are the intellectual property of KINPASS Sdn Bhd. You may not reproduce, distribute, or create derivative works without our written consent.
9. Limitation of Liability
KINPASS acts as a marketplace connecting Users and Partners. We do not directly provide activity services. While we vet Partners and maintain quality standards, we are not liable for injuries, damages, or losses arising from activities booked through the platform.
10. Changes to Terms
We may modify these Terms at any time. We will notify you of material changes via email or in-app notification. Continued use of the Service after changes constitutes acceptance of the updated Terms.
11. Governing Law
These Terms are governed by the laws of Malaysia. Any disputes shall be resolved in the courts of Kuala Lumpur, Malaysia.
